very cool. very natural looking. the background is just a bit 'busy' and detracts a bit from the main focus, but still, very nicely done!

If I understand what your saying then these monkeys are really old real life toys.
Then that makes Constantins picture all the more impressive not only for how closely they resemble them. But also for the type of detail going into the scene as well as a tribute to the toymaker. Possibly your mistaking the scene to be a picture of those toys. I am fairly certain that he modeled them in a 3D program. As almost all of the other elements in the scene have FF produced textures on them. In which case he would have been referring to the copyright of the rendered scene. If Constantin decided to sell 3d versions of the monkeys then I think you might have a case as to them resembling the monkees too much. But I am not sure of the details of that part of the law that type of point might fall under trademark. at least 90 percent of all sensation is texture, even beyond the visual, with elements of noise, tone, gradients, interval and degree.

I just think IWeber is pointing out that the model look like these real "toy" monkeys, and therefore the model is not just something the author got from his own imagination. So i dont think his questioning whether it's a rendered model or a photo.
