  • ok to use textures?
Author: Rawn (RawArt). Just thought I would post the info from Kraellin's link to help make it easy to understand "Intellectual Property Copyright, trademark and all other proprietary rights in the Content (including but not limited to software, services, audio, video, text and photographs) rest with Filter Forge and/or its licensors. Unless otherwise specifically provided herein or authorized ...

  • Concerning forum spam
Author: Rachel Duim. Lots of commercial artists here. Showing your work is fine if there are no copyright issues. I like the mix of the commercial and the creative here, keeps it real.

  • Copyright Law (as opposed to myth)
Author: StevieJ. "Kraellin wrote: notice specifically the use of the term 'tangible'." Yeah.....and that's exactly what the new EULA will do.....give authors "tangible" copyrights..... Good post!!! :)

  • "All your filter are belong to someone else!"
Author: StevieJ. LOL.... It's not a passage, but a fact of copyright law. I have alot of lawyers in my family.....and I have to listen to this crap all the time ;) :D LOL....

  • Image and Filter Copyrights?
..., please point me to the right direction) I noticed that there are several images made with very recognizeable filters from this site being sold on another CH site without obvious mention of Filter forge or Filter authors. How does that fit into copyrights and rights of autoprship for filter makers or for Filter Forge? If I use images made from same filters for 3D or graphics work that I make, how do I protect myself from someone claiming I'm using their product (images being sold on another ...

... where they are not .8bf type filters, they ACT like .8bf type filters in almost every regard. you can even add presets. i dont know how feasible this would be for FF to make available to authors, but i think it might be a solution to the whole sales, copyright, eula, re-seller thing. authors could make these individual FF filters and sell them, each by themselves. the eula would be whatever the author wanted it to be. FF could, if it wanted to, act as a sales point for these, if the author desired ...

... terms, you grant FF the right to use your filter in any way they seem fit and that FF may grant that same right to others to use your filter in any way they seem fit. that's how i read it. i'm assuming that 'derivative work' is defined by actual copyright law. so, you shld read the copyright laws on that one. i could read it to mean that ANYTHING produced by the filter is a derivative work, including presets, since those things derived from the filter and are not the filter themselves. and therefore,...

  • "All your filter are belong to someone else!"
Author: StevieJ. Well, I think from all this that we all agree that the EULA has some ambiguous problems.....most notably a conflict between author's copyrights and terms of use.... I think FF needs to come right out and say it point-blank in legal terms as well as easy-to-understand terms like this...... 1) AUTHORS ARE THE LISCENCED COPYRIGHT HOLDERS TO THE COMPONENT CONSTRUCTION AND PRESET ...

... domain. This guy mentioned above that my images are by him. It is a violation of my rights." According to our Terms of Use (http://www.filterforge.com/termsofuse.html), "You retain all of your ownership rights, including but not limited to Copyright, in your User Submissions." We've re-written the EULA to CLEARLY state that filter construction and presets are the copyrighted property of the author.....and that no third party can copy and resell them without expressed written agreement and consent of the author.... Further, we've decided to use texture presets to create and sell texture packages.....and give ...

Author: StevieJ. "Rawn (RawArt) wrote: to use the images themself would be a copyright infringment of this site" Not under the current EULA.....but it will be under the new proposed EULA..... ;) :)

  • "All your filter are belong to someone else!"
Author: Kraellin. "Genie wrote: That is how I read it, from the very beginning. Authors only have their FILTERS copyrighted. Not presets, or resulting images." no, you still own the copyrights on the presets. you created them. they are yours. it's the licensing that allows others to use them unrestricted. ... license) in selling "FF results" as texture packages or sell it to clients in an artwork context (be it online or in real world), which I'd very much like to be able to do." The trouble is that most texture package vendors tend to claim copyright to the images in their packages, and the EULA's one agrees to by purchasing and using the texture packages is written as if the contents of the product are 100% vendor's work and rights. They can't claim rights to something they don't own to ...

Author: KGtheway2B. • Upcoming EULA changes, round two
... by man can be picked by another man. and you've still got the problem of presets versus rendered texture by users. all of these are 'derivative works'. and, there is another part of one of the Eulas that talks about users not having to display copyright notices. i would think that also implies putting in anything which designates or implies a copyright being held, like a watermark. so, that part of the Eula would have to be amended also. tricky business, isnt it :)

... Sphinx.. Yeah, probably.. but it seems its all in the detail, here's a quote from the wikipedia page (second block qoute): "Making minor changes or additions of little substance to a preexisting work will not qualify the work as a new version for copyright purposes. The new material must be original and copyrightable in itself" If I am hired to make portions for a larger production, could very well be textures, and I find good filters and presets in the lib (of which there are alot), which ...
